A Tulsa County deputy saw a car with California plates, ran it through Flock, and pulled up a month of the driver's movements across several states, with no warrant and nothing more than the out-of-state tag to go on. He then stretched a traffic stop into a dog sniff and a search.

Federal Judge Sara E. Hill in Oklahoma threw that evidence out. Most courts have said license plate readers aren't a "search" because you have no privacy on a public road. Hill disagreed: Flock "is a type of indiscriminate mass surveillance," and "freedom from persistent, dragnet-style surveillance while in public…is a reasonable expectation." Over 30 days the deputy had more than fifty sightings of one car at his fingertips. She also rejected the idea that ordinary road-trip behavior, like a short trip, too much luggage, or nerves around police, adds up to suspicion.

It isn't just courts. In Kyle, Texas, the city council voted this week to cover its Flock cameras and keep them off until residents vote on them in May. Other towns are pausing or dropping their contracts too.

A month-long location log of every driver shouldn't be one click away for any officer with a hunch. One judge and one city council just said so out loud.
